Acceptance

By accessing or making a purchase from Rocky's Gallery (https://rockysgallery.com), you agree to be bound by these Terms of Service.

The store

Rocky's Gallery is operated by Guy Hutchins, a Project Sparks venture, based in Half Moon Bay, California, USA. We sell digital art files for personal, non-commercial use unless otherwise specified.

License granted with each purchase

When you purchase a digital download from Rocky's Gallery, you receive a non-exclusive, non-transferable, perpetual license to:

  • Display the file on your personal devices and screens.
  • Print the file for personal display in your home or office.
  • Make backup copies for your personal archival use.

You do not receive the right to:

  • Resell, sublicense, or redistribute the file.
  • Use the file in commercial products or services without prior written permission.
  • Claim authorship of the artwork.
  • Modify the file and present the modified work as original.

1/1 Drops

Items in the 1/1 Drop tier are sold under an exclusive license: when one is purchased, the image is retired from the gallery and is not resold. The buyer is the sole authorized owner of that image's digital license. Items that go unsold during their 24-hour window are demoted to the standard tier.

Pricing and payment

All prices are listed in U.S. dollars. Payment is processed by Shopify Payments and our authorized providers. We reserve the right to modify pricing at any time. Past purchases are not affected by future price changes.

Intellectual property

All artwork on Rocky's Gallery is the original creation of Guy Hutchins / Project Sparks unless otherwise credited. All rights not expressly granted in the license above are reserved.

Limitation of liability

Rocky's Gallery is provided "as is." We are not liable for any indirect, incidental, or consequential damages arising from use of the store or the digital files.

Changes to these terms

We may update these Terms of Service from time to time. The "Last updated" date above reflects the current version. Continued use of the store after a change constitutes acceptance of the updated terms.
